Field Budget Terms of Use

Effective October 21, 2026
Effective October 21, 2026. GEMx LLC Support and privacy: support@gemxag.com Mailing address: 211 E Beverly Dr, Indianapolis, IN 46205, USA
1. Your agreement with us
These Terms govern Field Budget, at fieldbudget.com and agrowknow-field-budget.netlify.app and through its applications, farm and field budgets, crop comparisons, saved plans, actuals, receipts, exports, maps, and related tools (the “Service”). “We,” “us,” and “our” mean GEMx LLC. By affirmatively accepting these Terms, you agree to them. If you act for a farm, company, or other organization, you represent that you are authorized to bind it, and “you” includes that organization where appropriate. If you cannot legally enter a binding agreement on your own, a parent or legal guardian must accept these Terms on your behalf and authorize any purchase. The Service is initially offered for use in the United States. Coverage, features, and purchasing options vary by location and platform. Our Privacy Policy explains information processing; accepting these Terms does not provide blanket consent to optional marketing or unrelated uses of personal information.
2. Budget estimates, field information, and financial records
Field Budget supports farm planning and recordkeeping. It does not guarantee yields, crop classifications, input costs, rent, market prices, profits, cash flow, or other economic results. It is not an accounting certification, audited financial statement, lender approval, tax return, land appraisal, insurance determination, or recommendation to trade commodities. Outlook calculations use your entries, manual overrides, selected assumptions, dated reference information, and models. Reference costs, estimated rent, soil adjustments, crop histories, inferred crops, and county planting dates may be incomplete, outdated, revised, or inappropriate for a particular field. A county-average planting date is not an observation of your operation. Review source dates, units, crop years, assumptions, and your own records. Saved plan versions preserve their original assumptions; saving does not validate accuracy. Economic costs and cash payments are different. An owned-land opportunity cost or depreciation allowance does not establish that you paid cash. Planning costs are not actual expenses. Actuals depend on the receipts, allocations, harvest, inventory, sales, lease terms, and records you enter. Check completeness, avoid duplicates, reconcile sources, and review exports before sharing with an accountant, lender, landlord, or adviser. An export is a copy of selected records and assumptions, not proof that all financial activity is included. Commodity prices may be delayed, cached, aggregated, or based on selected contracts or historical periods. They are not executable quotes, local cash bids, trading recommendations, or price guarantees. Field Budget does not execute trades. Verify dates, contracts, units, basis, delivery terms, and sources independently. Boundaries, classifications, and calculated acres are not surveys, proof of ownership, or permission to enter land. Confirm boundaries, farm assignments, crop, irrigation, and acreage. A proposed or inferred crop does not establish that it was planted. Experimental models and preview tools may have narrower coverage and validation. Do not use the Service as the sole basis for planting, input, lending, leasing, contracting, hedging, insurance, legal, or tax decisions. Check authoritative sources and actual conditions and consult qualified advisers. Follow equipment requirements, pesticide labels, and applicable laws. Nothing here removes rights or obligations that applicable law does not permit us to exclude.
3. Shared accounts and workspace access
Field Budget uses the AgrowKnow shared account and workspace system. Other participating products include Crop Tracker, FieldCast, and Seed Plan. A shared account, subscription, or sponsorship does not by itself grant access to another person's fields, budgets, receipts, or every participating product. Field Budget maintains its own saved plans, actuals, and product records; shared sign-in does not imply automatic synchronization of edits across products. Provide accurate account information, protect your credentials, and promptly report suspected unauthorized use. Workspace owners and authorized administrators control membership and permissions. Only upload, access, export, or share information you are authorized to use. Do not share an individual login to bypass account, field, or subscription limits. A sponsor may pay for access and receive information needed to administer that sponsorship. Sponsorship alone does not authorize access to private boundaries, financial records, receipts, or operational information. Additional sharing requires applicable workspace permission or a separate, clearly explained authorization.
4. Your data and our license to operate the Service
As between you and GEMx LLC, you retain your rights in the field boundaries, farm records, budgets, actual expenses, receipts, harvest and sales records, lease information, crop and management inputs, photos, and other content you supply (“Customer Data”). Uploading data does not transfer ownership to us or give you ownership of third-party source data. You grant us a nonexclusive license to host, copy, process, transmit, and display Customer Data as reasonably necessary to provide the Service, generate your results, support your account, maintain security, comply with law, and carry out your sharing instructions. This license lasts only as needed for those purposes and the retention described in the Privacy Policy. We apply these limits to our handling of Customer Data throughout the shared AgrowKnow platform. We require service providers processing Customer Data on our behalf to use it only for the authorized purposes, protect its confidentiality, and comply with applicable retention and deletion requirements. Payment providers and other third parties that process information for their own legally permitted purposes are described in the Privacy Policy. We do not sell identifiable Customer Data, use it for targeted advertising, use it to train general-purpose AI models, publicly display your private farm records, or give sponsors access to those records merely because they pay for your subscription. Any proposed separate research use or change to these limits requires a clear advance disclosure and your separate affirmative permission. Declining that optional permission does not reduce access to the Service you purchased.
5. Free access, trials, and availability
Free features, trial duration and eligibility, planning years, saved-record access, field allowances, storage, and exports are described in the offer or account. A no-card trial does not automatically become a paid subscription. Beginning another AgrowKnow product does not restart a Field Budget trial. A reference to a future plan or bundle does not make it available before launch. When trial, paid, or sponsored access ends, the applicable free features and existing-record access follow the offer you received. Losing premium access does not itself delete your account or field history. We do not promise that every dataset, storage allowance, model, or export is free. Material reductions to an already-paid offering are subject to the notice and unused-prepayment protections in these Terms.
6. Purchases, renewal, and cancellation
If you choose a recurring paid plan, it renews automatically for the period disclosed at checkout until you turn off renewal. Before purchase, we disclose the seller, included products and features, field or usage allowance, amount due, taxes, billing interval, and recurring-charge terms. You separately confirm that purchase; accepting these Terms alone does not authorize charges. Where web subscriptions are offered by GEMx LLC, Stripe processes payment. Prices are in U.S. dollars and exclude applicable taxes unless the offer states otherwise. The confirmed total controls. Only expressly included products are included; a shared login does not make other products free. For a web subscription, use the subscription-management link supplied with the purchase or the account's billing controls to stop renewal before it is processed. Contact support@gemxag.com if the control is unavailable or you need help. Cancellation stops future renewals and normally preserves access through the paid term. Removing an app, deleting a field, signing out, or turning off messages does not cancel a subscription. Apple or Google Play purchases, when offered, follow that store's management and refund process. Plan changes and prorated charges must be shown before confirmation. We give advance notice of renewal-price and material paid-plan changes, with an opportunity to cancel, and obtain additional consent where required. We do not retroactively change the price for a paid term. The offer explains field-counting rules. An offered bundle may count the same canonical field once across included products. Archiving or deleting a counted field does not ordinarily restore its allowance; contact support to correct a genuine duplicate or mistaken addition. We do not authorize an undisclosed overage charge. Failed payments may be retried under the payment-provider arrangement, with notice and restriction of premium access after any applicable grace period. Failure does not itself erase Customer Data. Sponsorship and a direct subscription may overlap; sponsorship does not automatically cancel a separate subscription.
7. Refunds
Contact support@gemxag.com with the account email, purchase date, and issue. We review web-subscription refund requests case by case, including duplicate charges, billing errors, and significant service problems. Cancellation does not automatically generate a refund, and a discretionary refund is not guaranteed. We provide refunds required by applicable law. Nothing here limits a statutory cancellation, refund, or payment-dispute right. A full refund normally ends the paid entitlement associated with that purchase, although another valid subscription or sponsorship may still provide access. Store purchases follow the applicable store's refund process. A refund does not itself delete your account or fields.
8. Communications
We may send necessary account, security, invitation, billing, and legal notices. Optional alerts and marketing follow the choices and channels shown when offered. Using Field Budget does not by itself subscribe you to optional marketing email. Delivery timing is not guaranteed. Use the applicable settings or unsubscribe mechanism for optional communications. Marketing choices are separate from service messages. Accepting these Terms or providing a phone number does not authorize unrelated marketing campaigns, automated marketing calls, or texts.
9. Permitted use and intellectual property
We grant you a limited, nonexclusive right to use the Service for your authorized activities during your access period. We and our licensors retain rights in the application, branding, software, models, and other materials we provide. Third-party data remains subject to its own rights and attribution requirements. The inclusion of government or other provider data does not imply endorsement of Field Budget. You may use your results in your own authorized farm or advisory work, subject to any third-party restrictions displayed with them. You may not resell the Service or bulk redistribute licensed source data without permission. Do not circumvent security or usage limits, access other users' data without authorization, introduce malicious code, disrupt services, or remove required attribution. These restrictions do not prohibit activity that applicable law expressly protects.
10. Availability, suspension, and termination
We may maintain, update, or discontinue features and may suspend access for misuse, security risks, nonpayment, or legal requirements. When reasonably possible, we will explain a suspension and provide an opportunity to resolve it. Urgent security or legal situations may require immediate action. If we discontinue a paid Service or terminate your paid access for reasons other than your breach, we will provide an appropriate refund for the unused prepaid portion, subject to applicable law. We do not promise uninterrupted availability or a particular service level unless separately agreed in writing. You may request account closure and data deletion through the process described in the Privacy Policy. We will distinguish Field Budget-only removal from deletion of the shared AgrowKnow identity and explain effects on other products, shared records, and outstanding subscriptions. The provisions that by their nature need to continue, including payment obligations already incurred, intellectual-property protections, lawful retention, and dispute terms, survive termination.
11. Warranties and liability
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and noninfringement, and do not warrant that information will be accurate, complete, continuously available, or suitable for a particular operation. To the maximum extent permitted by law, GEMx LLC and its service providers are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost business, or lost data. Subject to the exceptions below, our total liability arising from the Service is limited to the greater of US $100 or the fees paid for your Field Budget access in the 12 months before the event giving rise to the claim. These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, or liability and remedies that cannot lawfully be excluded or limited. They do not eliminate nonwaivable consumer rights.
12. Disputes, changes, and general terms
Contact support@gemxag.com to seek an informal resolution. You remain free to use available statutory remedies and eligible small-claims procedures. Disputes may be brought in a court that has jurisdiction under applicable law. These Terms do not require arbitration, waive class-action rights, or limit any mandatory consumer protection or right to bring a claim in a legally available court. We will identify the effective date of updates and provide notice of material changes. Where a new agreement or consent is required, we will request it. Changes will not retroactively expand our rights to use previously collected personal information without a lawful basis and any required consent. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. These Terms, the purchase terms you accept, and any separately signed agreement govern your use of the Service. A separately signed agreement controls an express conflict within its scope; a specific checkout offer controls its disclosed price, duration, and included plan. Questions and notices may be sent to the contact details above.
Questions may be sent to support@gemxag.com.
